Performance Evaluation Appeals
Educators may appeal their evaluation results in accordance with the South Carolina State Board of Education Expanded ADEPT Support and Evaluation System Guidelines based solely on the procedures, below. Professional and support staff evaluations are not considered grievances pursuant to Administrative Regulation HRS-15.
If an Annual or Continuing Contract teacher is dissatisfied with the results of his/her Final Evaluation, he/she shall have five (5) calendar days from the date of receipt of his/her Final Evaluation results to submit a written appeal to the BCSD Chief Human Resource Services Officer. The written appeal must set forth one (1) or more specific ground(s) for appeal. Appeals citing general disagreement with the educator’s evaluation results without one (1) or more specific ground(s) for appeal will be summarily denied.
The Chief HR Services Officer, or her designee, will review the document(s) provided by the appealing teacher, may meet with the appealing teacher and/or others, and will notify the appealing teacher of the decision in writing within ten (10) business days of receipt of the appealing teacher’s appeal or meeting with the appealing teacher, whichever is later. In order to ensure a full review and determination, the deadline for response to the appealing teacher may be extended in the sole discretion of the Chief HR Services Officer or her designee.
If the teacher believes the determination of the Chief HR Services Officer or her designee is in error, he/she may appeal, in writing, to the BCSD Superintendent. The appeal, in writing, must be submitted to the Superintendent within five (5) calendar days of the date of the Chief HR Services Officer’s decision. The appeal must contain one (1) or more specific grounds for appeal from the decision of the Chief HR Services Officer. Appeals lacking one (1) or more specific ground(s) for appeal will be summarily denied. The Superintendent is not obligated to meet with or otherwise grant a hearing to the appealing teacher pursuant to this procedure.
Nothing herein shall be construed as modifying an educator’s rights pursuant to the South Carolina Employment and Dismissal Act, S.C. Code Ann. § 59-25-410, et seq.
No teacher or other certified staff members may grieve the results of his/her informal evaluations, including Goals-Based Evaluations. The decision of the Principal shall be final.
